Çocuk hakları, dünyanın her yerindeki tüm çocukların doğuştan sahip olduğu sağlık, eğitim, yaşama, barınma; psikolojik, fiziksel veya cinsel sömürüye karşı korunma gibi haklarının hepsini birden kapsayan hakların tamamını kapsayan evrensel haklardır. Çocukların üstün menfaati temel alınarak onların temel ihtiyaçları ve istekleri, hukuki bir metin olan "Çocuk Haklarına Dair Sözleşme/Çocuk Hakları Sözleşmesi (çocukların Magna Cartası)" kapsamında ortaya konulmuştur. Çocuk haklarına dair ayrı bir uluslararası sözleşmenin imzalanması, çocukların özel olarak korunmasının gerekliliğini ve başlı başına çocukların eğitim hakkının temelini oluşturmuştur. Bu tez çalışmasının amacı; çocuk hakları bağlamında eğitim hakkının incelenmesidir. Bu kapsamda; hem genel olarak çocukların eğitim hakkının incelenmesi hem de özel çerçevede, bu hakkın uluslararası alanda ve ülkemizdeki durumunun incelenmesi hedeflenmektedir. Söz konusu incelemelerde; çocuk haklarının tarihsel gelişimi, düşünce ve inançlarda çocuk haklarının ne şekilde ele alındığı hususuna da yer verilmiştir. Daha önce tezin konusu olan uluslararası alanda ve ülkemizde çocukların eğitim hakkına yönelik herhangi bir yüksek lisans çalışması bulunmadığından; yapılan bu çalışma, bu konuya yönelik eksikliği giderme noktasında oldukça önem arz etmekte olup söz konusu tez çalışmasının son yıllarda gelişen çocuk hukuku müktesebatına da katkı sunması hedeflenmiştir. Children's rights, health, education, life, shelter, which all children all over the world are born with; They are universal rights that encompass all of the rights, such as protection against psychological, physical or sexual exploitation. Based on the best interests of children, their basic needs and wishes are set forth within the scope of the legal text "Convention on the Rights of the Child/Convention on the Rights of the Child (Children's Magna Carta)". The signing of a separate international convention on the rights of the child established the necessity of special protection of children and the basis of the children's right to education. The purpose of this thesis study is; It is an examination of the right to education in the context of children's rights. In this context; It is aimed to examine children's right to education in general and to examine the situation of this right in the international arena and in our country in a specific context. In these investigations; The historical development of children's rights and how children's rights are handled in thoughts and beliefs are also included. Since there is no previous postgraduate study on the subject of this thesis, which is the right to education for children, in the international arena and in our country; this study is of great importance in terms of filling the gap on this subject and it is aimed that the thesis study in question will also contribute to the acquis of child law that has developed in recent years.
